Cheating or no ..

We've been together for four years. We have tried to use a condom once or three times and today a condom fell out of his book bag out of no where and he says its an old one we didn't use . Keep in mind it was open.. We don't use condoms at all** .. We have tried to a few times and didn't even use it period.. Is he cheating ???
