Oh joy jury duty......and here's your case.

-Hypothetical scenario-
-A man leaves a bar and decides he's okay to drive. Only having a couple drinks. He will be known as Driver A.
-A man leaves his friends house. He doesn't like wearing a seat belt. He will be known as Driver B.
Both driving home end up in a car accident. According to the investigation it looks like driver A went around the sharp corner half in the other lane. Driver A is rushed to the hospital with non life threatening injuries. It was established that his blood alcohol content was .079 legal limit .08
Driver B is pronounced dead on scene. It's established that he was not wearing a seatbelt and he would have probably survived if he was wearing his seatbelt. 
- it's a law in the state you must wear a seatbelt. 
Driver A is in court and you the jury need to decide does he get charged with the death of driver B even if his death was because of his own negligence not wearing his seatbelt.
