Daycare Custody Liability

A couple has a child. 3 years later, they split up. Both have partial custody and they take the child to the same daycare: the home of the man's sister in law. The child is the sister in law's niece.

The mother drops off the child. She has custody for the full day.

At the end of the day, the father comes to pick up the child (despite the fact that it is not his day) and says he talked to the mother, and she wanted him to pick up the child today because she is working later than usual.

Should the child be released to the father?
