It depends on the state tbh. Some will insist on DNA. Others go by birth certificate.

I am a licensed funeral director for the state of PA and they will want DNA to prove the child is his. They can do this by getting DNA from one of your husband's brothers, family members, ect. SS will not exume a body to get DNA.

I finally found out!!!

Per social security;

As long as I deliever upto 9 months to the day of his death I can just put my late husband done as deceased on birth certificate.

If it's & months and 1 day.....

Depends on state but since he passed before the baby was born I think u more than likely will need proof of paternity .. Are their relatives alive that will help you?

When my step father passed away I was 17 and since he raised me from the time I was three, my mother was granted benefits for me. They didn't need proof that he was my father just wanted to know how long he was in my life and supported me. This was also 6 years ago so idk. I don't know all the details but we live in Oklahoma and I have no idea on the law on it.
