Claiming kids on taxes?

If a mother doesn't work, receives government assistance and child support who gets to claim the kids for taxes? The mother or the father?

Depends on what the custody arrangement says.

Unless it's 50/50 custody, and that usually means they take turns every other year, other wise legally it states who ever has the child 60% of the time. Who the child lives with. My ex took me to court asking the judge to let him claims on of our girls and I claim the other. The judge looked at him smerked. Sir he said I can't force her to let you claim a child, that under federal law she is legally aloud to claim. I can't change a federal law, I'm a state judge. My ex was mad. The kids live with me, so I have them more then 50% of the time.

The dad can if he work. If the mom hasn't worked she won't get anything. Probably have to pay
