Jail time

I don't know who else to ask so I'm asking here. A couple days ago my ex physically assaulted me and I called the cops and got a temporary restraining order until the court date. Anyways he has a class C assualt felony for choking me because he could have killed me. This felony is punishable with 3-15 years in prison and a big fine. He's also had a previous order of protection and has violated it a few times. My question is do you think the judge will let him off on probation since it's his first real offense? Or will he get some jail time? I'm worried he will come after me or my baby since he obviously has no problem violating restraining orders
