UPDATED Am I right for doing this? WARNING MAY BE DISTURBING TO SOME.

:::::::UPDATE:::::::: I feel I didn't go into detail about what happened so for the people asking here's what I was told by the teacher and what I saw on the cctv footage.

My son and some other children were swinging on a metal gate that separates the younger children from the older children, there were 2 teachers supervising about 30 3-4 year olds, having seen my son and some other children swinging on the gate they proceeded to tell them to stop and walked away without locking the gate or moving the children away (cctv footage was shown) they continued to play and swing on the open gate which should have been closed and resulted in my son getting his finger trapped in one of the numerous holes on the gate that were there to lock the gate if that makes sense and cut it clean off just below the finger nail. They admitted afterwards that the gate did not "lock" as it was broken and they could only close it which the children were able to open which is how the accident happened.

I feel if the gate wasn't broken and the teachers went on to seccure the gate after the first time they saw him playing on it then it could have been avoided and my son would still have the tip of his finger, I know children will be children and accidents do happen but in this case it shouldn't have happened, it very well could have been avoided and that's why I decided to sue the school.

Okay so back in 2014 my 4 year old son had his finger amputated just below the finger nail at school during breaktime on a gate which was NOT up to saftey standards which the school admitted and have now corrected the gate.

As you can imagine this was a very traumatic experience for my son and everyone in involved. A family member recently brought up the fact that I never claimed compensation for the incident and advised me to do so (didn't even cross my mind at the time I was just focused on my son getting better)

I contacted a solicitor who agreed to start a claim for me so I went ahead and accepted, I have since told some friends about this and some have said I shouldn't have started a claim against the school and "accidents happen all the time" that I should be thankful he's okay although missing his fingertip and not make a claim against the school.

I'm not sure how to feel about it all, I know the school was in the wrong by having a gate that wasn't up to saftey standards and as a result my son had to suffer and it's something that he will have for the rest of his life now so the money I will receive will go into a trust fund for him to be opened when he's 18.

Anyhow I was just wondering what are all your thoughts on this? Am I in the wrong? Have I done the right thing?
