Weed and rape.

I am sorry this is long. Last night my friend asked me to help him study for his college exam. When I got to his house we studied for three hours. Then he started to smoke weed because the studying was stressing him out. I do not smoke. He was high, shoved me to the ground, then started to rape me. After he fell asleep I quietly got my things and ran out of the house. I have bruises all over my body, I can barely walk ,and I put the semen stained panties in a ziploc bag. My girlfriend noticed I had bruises all over me and noticed I do not want to walk or be touched. She put the pieces together and knew that I was assaulted. Today my "friend turned rapist" texted me and said "That was some of the best sex I have ever had. Weed makes everything better."

He has always joked around and said that in our state where weed is legalized, raping someone while high will never be a crime because weed is not a drug and people don't cause car accidents while high. I have these messages in a screen shot for evidence even though I know it won't matter.

My girlfriend keeps wanting to call the police. I wanted to call the police at first but now I am so terrified. What if he's right and he won't go to jail for raping me while high? That just keeps playing in my head. Has anyone been in this situation? Also, if/when I call the police, do I need to give them the panties or do I have to wait for a rape kit to give the hospital the panties?
