So my baby daddy's mom is telling me she's going to take me to court after she gets her sons rights, so she can see my daughter every other weekend. Can anyone tell me if that's even possible? Her son is incarcerated and will be for the next 6 years. My daughter will be 5 in June and he's been in and out of prison since she was born & has never provided for her in any type of way. He's been around her only bc it was court ordered but besides having her every other weekend at his moms house, where his mom was the one looking after her he had no type of relationship with her. We are in NC btw!! Just wanted to get others input on this.

Grandparents do not have rights unless you are an unfit mother, the court cannot impose for her to have visitation rights

There are no established grandparents rights. It is up to your discretion. The child is 5 yo. It would be very difficult for her to establish grounds if she has no relationship in the first place. Once he is out of jail he can petition for parenting time. There would be a lot the court would take into consideration at that point. Just ignore them.

I was somewhat in your passion my sons dad was in prison when I had my son he was in prison for 3 years but his mom even though she was a pain and we didn't see eye to eye on anything she was still my sons family so I kept her from him .to me it's wrong unless there is reasons to. She did threaten me once to take me to court but I said your the one cousing yourself to not see him so go ahead  she never did instead she decided to be civil and get her grandson  . Unfortunately she has passed way and my sons dad never gets him cuz he doesn't know him. My son is now missing out on his bio dad's family completely and I wish it wasn't this way . Why do you not want her to see her grandparent?

I'm going through something similar. My daughters father isn't in jail and gets visitation our daughter two and a half days a week. He's had a fallen out with his mother. Our daughters grandmother. And she's constantly saying she's gonna take him to court for grandparent rights. I'm in nj and there's no such thing here. I would look up grandparent rights in nc and see what comes up. And speak to a lawyer for a free consultation just to get some insight.

Also her father is a registered sex offender (no he was not guilty, this I can vouch for) BUT he does have that charge unfortunately, also has multiple drug charges, was busted IN FRONT OF MY DAUGHTER to the point the cops had guns pointed at her during this drug bust, and his mother also has drug charges and has my child staying in a roach infested house when she has my daughter! So this is not out of spite, this is simply me trying to protect my child. If I would've done anything while he was free I would've had to pay thousands of dollars that I don't have in lawyers and court fees.
