Does anyone know how I can change my children last name

I was once married now divorced n my kids have my ex husband last name they r 4 n they never knew there dad based on his own deaddeat choices but anyway I will be getting remarried next year n want my children and myself to take my new husband lastname not sure how I do this . Note there bio dad has been MIA for over 2 years

I went to court with proof my ex wasn't in my daughters life. I got her last name changed to mine. Now I'm remarried and he's in the middle of adopting her and she will have his last name. Most court houses have a free help center.

I have never been in this situation, but...... Isn't she able to simply do a name change? How does changing the children's last name affect paternal rights??

Now, if we are talking about getting him to sign over rights so he never can see them and doesn't have to pay child support, or so her new husband can adopt them, then yes, legal action would be required......

I had a friend in a similar situation but she wanted to change her daughter's name to the same as hers because the father was absent from her life. I believe she petitioned the court for a name change and they sent him papers informing him about the change and he had the right to object. He did not object and she was able to have her name legally changed. I don't know if this would be different in your case because you are getting married or not. But talk to a lawyer or call your court system and find out. They will tell you whatever you need to know. Good luck!

When my friend remarried, her new husband had to legally adopt her kids in order for them to have his name.  Good luck!

You will have to go to court to change it if bio dad is on the birth certificate you will either need his signature or a court order.

I think when you marry you can legally change their name , otherwise if not it would require his permission , after 4 years of no contact you may beable do it by deed poll .... I'm stuck in a similar situation myself it's not far 4 years now in august it will be and il definitely be applying through deed poll gain then as I'd rather not remind him he has children, he may try to go for contact and my solicitor said he'd most likely get it, so avoiding anything that involves him, a friend of mine was allowed to change her daughters name by deed poll because the father has been arrested for beating the crap out of her, and there was strict rules in place that he couldn't contact her or have contact with the baby because of his violent history and he was made by the court to had over parental rights x
