If you didn't say no to having sex but also didn't say yes is it rape?? I was really little and I didn't think that anyone would believe it so I just let it happen. The guy who did it was 6 years or more older than be and I was about 5.

In any case, age difference does not matter. If no consent is given and genital penetration happens, it can be and will be, regarded as rape in court of law. And remember, any person under the legal age of 18 is still considered a minor and even if both parties say yes, it can still be regarded as rape. That all being said, its been a long while since my criminal justice classes so please feel free to fact check me. Also, if you are drunk and do the dirty, it can also be regaurded as rape 😉
