Legally out of luck right?

I just bought a Nintendo DS from a girl and I am usually really careful when I buy used things, I even had her send me a video of the DS turning on and loading a game and everything. she shows up with that exact DS and she didn't even give me time to test it out. She took the money from my hand (i wasn't handing it to her) and went out the door from my work and left. The stupid thing doesn't even turn on. It charges, but doesn't turn on. She also said that Mario Kart the game was also coming with it since I was paying $75 for a used DS and there is no Mario Kart. I hate myself. I am a giant idiot.

There is nothing I can legally do besides make the admin of the site she contacted me through aware that she sells things that are broken right? If you have any advice on what to do legally please help me. It was gonna be my sisters birthday gift.
