Who should be sued?

So Kylie Jenner is being sued over artwork again. It got be thinking about how this has happened in other situations when artworks have been very similar to artwork owned by another person/company. I HIGHLY doubt Kylie Jenner drew out the design and had it made. However, she is being sued. In situations like this, who do you think should be sued. The head of the company, the artists working for the company, or someone else?

The owner because no matter what it has her name on it. She approved it and she is going to make money off of it!

The owner, just because you're famous & everything is done for you, it's still your business, it's your job to make sure whatever is being put out is original as it has your name on it & it's your brand.

With artwork and within the art community it's accepted that generally there will be a replica of your work somewhere out there purely because all of our ideas aren't that original, HOWEVER when two artists find each other's work and see similarities nothing is usually done (because styles can be very similar) UNLESS there's pieces that are uncanny in their similarity, in which case the artist to first have released the work or who marketed etc will usually request an adjustment to the other's work.
So Kylie's artist's may have, MAY HAVE, which I highly doubt because the woman she replicated was well known and established, coincidentally created the same design, but it's Kylie's job to oversee that and go "no this isn't mine". 
Like Ivanka is being brought to court AGAIN for copying another shoe companies design, same company she's copied from already, because she's making revenue off of knockoffs. Her defense was she doesn't oversee the final product, but the attorney or judge stated that it's her job to watch that.

Not just her.. they all do. Khloe and her bejeweled body suits? Copied. In fact her assistant ordered one of each from a struggling designer. Few months this later Khloe added them to her line. Sue the lot of them!!

The owner of the copyright, no one else could sue, they have no right so it would just be thrown out.
