Medical marijuana is legal in my state

Ive tried everything for my "all day sickness" (morning sickness) and nothing works. Ever. I'm constantly miserable. The only thing that helps me is literally smoking and relaxing in my bath tub.

My question is.. medical marijuana was not legal in my state when I had my first baby a year ago.. I had an open case with CYS & stopped smoking till I recently got pregnant again and they closed the case. Well I'm pregnant again & now that its legal is it possible for them to reopen that case and come after me again? I mean I can stop whenever I want too, it's not a problem to quit for me but like I said, nothing helps me but smoking.

I know this girl who smoked her whole pregnancy because her dr told her to not quit smoking because it could potentially put stress on the baby and she was in the same boat I am. Nothing helped her morning sickness either.

PLEASE NO MEAN COMMENTS. I smoked almost my whole pregnancy with my first and he is the smartest 1 year old I have ever met in my life. Like it didn't affect him whatsoever. I just don't know what to do.
