Will he be granted full custody

Question

Does anyone know how this works? I’m in PA & I would talk to a lawyer but doesn’t that cost? My 1 month old daughters father & i just aren’t getting along so now he’s putting me out. I said ok that’s fine, I’ll leave but I’m taking her too & she’s breastfed. So he’s saying he has lawyer friends & I won’t get custody because I don’t have a income. I’m on maternity leave, I’m not unemployed. He actually works 2 jobs so he wouldn’t even have time for her. He’s not a bad parent but I do feel I’m more fit than he is plus he’s been abusive towards me in the past & I told him I’ll show the pics if he tries to take my daughter away from me. He wants full custody so I can’t put him on child support

If I were you, I’d just go get a lawyer. You can find one relatively cheap, or get one that will let you pay as you go. I did that for my divorce. He wasn’t the best, but I didn’t get screwed too hard.

Call legal aid - you can get advice without cost. It is unlikely he would get full custody in that situation.

Call an attorney. Some will give you a free consultation. If you cannot afford an attorney, legal aid is sliding scale based on income. If they can’t take you, call your state bar association. They should have a Volunteer Lawyer’s Project. It’s a program to pair people with attorneys doing pro bono work. Also, if there is a law school in your area, they may have a civil clinic where law students can handle your case. These “lawyer friends” of his are just a threat. The reality is MOST jurisdictions do not award sole custody to either parent unless there is really strong evidence that one parent is unfit or one parent does not want any custody.

Start with your local legal aid for advice, I don’t know much about PA law but I work for a NC attorney and it’s definitely worth calling around to see if anyone in your area has free consultations. Save all written communication with him and since you’re not an unfit mother he wouldn’t be granted 100% custody anyways

As long as you aren’t an unfit parent (meaning abusive, not properly caring for her, ect) then most judges want both parents involved in the childs life. At such a young age, and the fact that your breastfeeding though, you’ll likely end up with custody and he’ll get visitation as long as you continue exclusively breastfeeding because a child can’t be without food for very long. 
Once the child is weaned and older, it might be a different story. 
As others have suggested, go to a free consultation at the very least so you know where you stand for the most part

The mother normally retails custody. DO NOT GIVE HIM POSSESSION THE BABY!!!!! Keep baby with you to retain that ‘possession’

If he gets full custody he will probably put you on child support. But I suggest documenting everything.
