Co-signer/eviction.
Hey so I have a question not sure of the right place for this but if any one can help that’s great.
Question in short:
If tenants refuse to pay rent will they be evicted before the co-signer is asked to pay what is owed? Ie co-signer is last resort.
Background.
I recently moved out and left a bad living situation with and ex best friend and her friend. I ended up leaving a month before lease was up as they told me they didn’t care. My father was the co-signer of this lease and in order for him to be removed my ex roommates needed to qualify the requirements or get a new co-signer. The landlord won’t finalize the move out/co-signer removal as they have yet to get another co-signer for the lease.
Now they are saying I’m still responsible for February rent since my name is on the lease which before I moved out they didn’t expect me to pay that month, just January. We had a verbal agreement along with them signing the forms for my father and myself to be removed. (The only signature needed on the forms to make it official is our landlord’s) I want to know if they would be evicted for not paying rent before my father is asked to pay as co-signer on the lease? If that’s the case then ik they would pay rent and I can refuse to as I know they are not able to move out right now and would not want to be evicted.
