3 month old and divorce

I live in Pennsylvania and we have a 3 month old My husband and I are getting a divorce. There was no cheating involved, but he said he would use my mental health as a way to get full custody to my baby boy. My question is has anyone gone through this?? Will he get full custody? I don’t want to go through the courts but he starts work at 4am Monday through Friday, he can’t take care of our baby boy. Will mental health affect that?

I am currently going through a divorce and my ex threatened to use my depression against me in our divorce/custody case. His lawyer tried to request my medical records for my depression diagnosis be sent to the judge for review and the judge was annoyed. He said he had no reason to consider depression as a reason to grant one parent custody over another. I doubt your ex can use your mental health against you in your custody/divorce case.

I don’t think mentally healthy should effect your court hearing, as long as you show you are able to care of your child,you can maybe even ask your counselor to be an advocate for you,showing you are a good mom.I am not a LAWYER,so I do advise you to seek legal assistance.
