Working while pregnant.. discrimination?

Hey guys so I was just told by my hr that the company fires there pregnant employees before they go on maternity leave because if you haven’t been there for 1 year you do not qualify.... is this illegal ? Pretty upsetting and I wasn’t aware when I was hired on no signed documents regarding this .

From what I understand though, you aren’t protected under or qualify for FMLA unless you’ve been employed for 12 months. Even so I would hope they would work with you.

In order to qualify for federal FMLA in the US, you have to have been working for your employer for at least 12 months. I don't think you are allowed to get fired for being pregnant, but the company is not obligated to offer you paid leave or offer you a job when you are ready to return.
Depending on which state you live in, there may or may not be additional protections for you. Try contact your state's Department of Labor for more information.

They can't fire you for being pregnant, but they can let you go for taking leave, or anyone go for taking any kind of medical leave. 
The exception is if you qualify for FMLA. But only do you need to have worked there full time for 12 months, the place must employ 50 people or more to be bound to FMLA. 
Hopefully a good place will work with you eg rehire you. But unless you have FMLA protection, they have zero obligation to do so.
I own a business and handle the HR so I'm familiar with the laws.

Where I’m from its illegal to fire pregnant women. And you have to work with the company for a year and have at least put in 115 hours. I’ll be a year with my company next week. But I’m already on maternity leave at 39 weeks, because my boss is scared of my water breaking at work. You may want to check you state or country laws on pregnant women

My thought is... if they fire you though right before maternity leave can’t you get unemployment? I don’t know enough about unemployment, but maybe that is their way of giving you that option while you are gone?

They legally can’t fire you. They can however not pay you for maternity if you have been there less than 12 months. That’s how my company works. You can go on unpaid maternity though but your job would be protected.

It is illegal to fire you. They can withhold pay, and then would have to rehire you upon maternity leave ending. They cannot fire you though, you could sue.
