Texas law against taking your child out of state without father's consent?
So I am trying to leave my abusive husband with my 8 month old who was born in California but I know he won't let me go back to California with her. He is emotionally, verbally, and now physically abusive. He punched me a lot of times but didn't really leave noticeable marks besides this one in my arm (this happened on the 17th and my arms still hurt from the punches)
The only reason I didn't call the police was because he would have broken my phone and that's my only way to contact my family in California. We are currently living in Texas with his parents that enable that behavior because they witnessed him hitting me and being verbally abusive in my face but they didn't even seem worried about me. My cousin talked to the police back in Cali and asked what I could do and they say I can get to a safehouse, go to court and get something that'll allow me to take my daughter back to Cali, and eventually book a flight. My MIL threatened me by saying I can't legally take her without the father's consent because he can report it as kidnapping. Does that still apply to my daughter even though she was born in Cali? And what type of papers can I possibly get from a judge that'll let me take her out of Texas without her dad's consent?
