Should a judge be able to prohibit someone from having children by threat of prison? (read for context)
I was listening to a podcast (Serial season 3) about the Cleveland Ohio court house. There is a judge (like many) who make unconstitutional sentences. A man committed a federal crime and instead of sending him to prison, the judge put him on probation for 4 years. One of the conditions of his probation was that he was not allowed to have anymore children out of wedlock (he had one child already). So if the man were to have a child in those 4 years of probation then he would have to go to prison for violating his probation. (You know usually people violate their probation by committing a crime, getting into trouble, etc. and get sent to prison). This is unconstitutional because you cannot legally punish someone for having a child. What are your thoughts.
