For serving minors, absolutely. For over serving already drunk people, not in most cases.

Uh no... as an adult you should know not to get completely shit faced. Bartenders aren’t responsible for you. They’re already dealing with drunk assholes and working in a loud crowded area

If the purposely serve alcohol to a minor then yes they should be charged, unless the minor had a fake ID and they didn’t know. As for serving a drunk person to much alcohol it depends. I would imagine in a busy bar or club it would be hard to keep track of how many drinks each person had and not knowing their tolerance. Also not everyone is easy to tell when they are very intoxicated. So it really depends if someone is falling on the ground and can’t even stand up and they knowingly keep serving them alcohol then that is wrong.

No, I think that is a slippery slope and ridiculous. Drunk drivers have no one to blame but themselves. Charging bartenders for drunk driving fatalities means that culprits of DUI's can lessen their charges and shift responsibility.

No... personal responsibility... even if the bartender cut them off others could possibly be buying for them of there are multiple bar tenders, an open tab, and no one paying attention... the bartender didnt force the bottle to the others mouth

Idk where you all live but I was a bartender and bar manager for years in New York state and it is literally illegal to serve someone if they are visibly drunk. I have cut off several people in my time as a bartender because safety always comes first. It doesnt matter if they have a DD they could get alcohol poisoning or something else can happen to them you never know. It is 100% the bartenders job to recognize when someone needs to be cut off. You guys must be the worst bartenders ever, I wouldnt hire you. 🤷♀️🤣

If it's to a minor yes. If an adult drinks too much at a bar then makes the choice to drive home then no, absolutely not. It's not on anyone but the person drinking and driving.

Should the guy who sold me a car be charged if I crash it and hurt someone? Should the cashier who rang up my box of rat poison be charged if I use it to hurt someone? Netiher should the bar tender. Adults are responsible for their behavior and actions.

No you are responsible for drinking. Yes bartenders do cut people off on the amount of drinks. If you’re going to go get shit faced order an Uber for the night. I used to work at a Mexican restaurant chain popular in New England for its margaritas. We had these three old guys that were local and regulars and obviously heavy drinkers but they never drove and lived walking distance. Just before Christmas two of them (brothers) died in a house fire. The police investigated. The bartender that night and restaurant manager gave full disclosure because we all loved those guys and wanted to help. Well.....both the bartender and restaurant got charged with: Serving intoxicated patrons Giving away free alcohol (illegal in our state but the bartender made something wrong so he gave it to the guys instead of dumping it) Irresponsible service of alcohol The restaurant backed the manager but told the bartender he was 100% on his own to fight the legal battle (fucking awful). After 24 months the case was dropped because of statute of limitations and no evidence other than him recounting the evening. It’s a real thing that can happen and any restaurant job I’ve worked at since I’m super strict with my guests. Keep your tip and hate me idc I’m not fighting a $250,000 fine and facing jail so you can get trashed 🤷🏻♀️. But no, I think it’s dumb and people who are drinking need to be held accountable.
