No it’s illegal for outlet stores or stores in general to sell fake or counterfeit items. Many of the outlet stores get their merchandise from the overstock of name brand companies and are able to sell it cheaper.

Outlets carry past season items as well as items that have entered their depreciation shelf life.
For example, 
Michael Kors will have “sales” with like 10% off of items to generate cash flow and free marketing when the customer wears the product while also creating an incentive/discount for the buyer. If there are left over items or items that do not sell well after a certain amount of time, they will be sent to their outlet store or they are sold to an department store like Marshalls where they will be priced to sell at half of the actual cost.
This is why department stores carry past season items.

Not in the sense that its counterfeit. The myth of outlets is that it is its overflow stock or that it is stuff that didnt get sold. Those clothes are specifically made for the outlets and cheaply manufactured, and then they slap on the brand name tag on it

Sometimes a store just wants to specialise in a certain brand, sometimes a store wants to have many brands. Doesn't mean the stuff in the outlet stores are fake.
