Evict hubby?

Last spring my spouse was in jail for saying some nasty stuff about threatening my family

While away was texting me, promised me all this stuff that I knew could get us to be happy together

Long story short he moves back in & ends up doing everything he promised he wouldn’t. today we have a 6 month old.

Last spring when he was doing lots of stuff behind my back he was smoking weed. Since then he hasn’t brought it home & would smoke at his friends. This wk he brought a little home.

We argue a lot bc he cheated before marriage & during.

I have been contemplating divorce, but bc he brought the drugs home & we argue in front of our baby & bc he has spoken to the girl he cheated on me with I’m considering evicting him

I am unsure of his actions being on drugs

If you were in my situation & could evict him would you ? We are married.
