How is it legal for a landlord to come on your rental property & take something that doesn’t belong to them?

Our landlord came up under our stairs of our upstairs apartment & stole a child’s bike that I had for children that I babysit. He claimed he didn’t know it was ours and thought it was abandoned so he was going to add it to his yard sale he is having. He had no permission to do this. It was on our rental property. We are current on rent. How is this legal? I’ve contacted the sheriffs office and they said we needed to contact an attorney. I’m literally baffled at this whole situation!

My husband’s a landlord, and technically, the stairs are public domain so it’s legally like you abandoned it. 
It’s shitty, but it’s legal. However, he should have contacted you to find out who it belonged to, and then given notice if it still wasn’t moved. 
I think he was just trying to make a buck and be a dick though.

I mean, it’s legal for a landlord to visit their own property, and if he sincerely thought the bike was abandoned then it was just an honest mistake. Did he return the bike once he found out it was yours? If not, then I would file a written report that your bike was stolen.

It's theft but don't expect the police to care. Petty crime isn't worth their time apparently. Put cameras up and please, learn your rights as a tenant. Read your local tenancy laws.

Even if technically, you don't have legal recourse, you should see if you can pay into escrow a few months to fuck em over

He can definitely come on the property. It is weird he assumed it was just maybe left from a previous tenant.

I understand they have the legal right to enter our rental property etc but I asked permission to bring the bike to our home back in May. Permission was granted, so they knew it was ours. It wasn’t like it was laying on the ground. The bike was parked up under our stairs next to the small shed that is included with our rental property. There is also a grill there &  it wasn’t touched.
