REFUND ? $400.00

Does this sounds like it qualifies for a refund ?

I paid an apartment security deposit for a move in day of November 5, 2022.

The complex has a policy that you cannot get a refund for the deposit unless you cancel before 3 days after application approval.

Like a week later I was told that the current tenant extended their lease which pushed my move in date behind.

If they would have told me this before 3 days after approval then I could have told them never mind and got my money back . But they waited later after they confirmed I could move in at that date .

I canceled because the move in date didn’t work for me , they said I cant get refunded for the deposit not because I had to before 3 days after approval.

I'd fight it. Only because they purposely waited until outside the maximum timeframe to tell you. If you only have 3 days after to notify of cancellation, same rules *should* apply to them. They also have 3 days to notify you of issues. It's not right to wait until they're outside the timeframe to tell you that there's been an issue and your date is pushed back and then deny you a refund. Theft at best. Unethical business practice at minimum.

If there is anything with your move in date on amything you signed it becomes void because they chamged your move in date therefor you maybe eligible for a refund given they changed it not you and are in breech of the contract.

That’s their policy. There isn’t anything you can do. That was clearly stated in the policy when you put a security deposit down. Good luck trying to fight that.

I’d 100% fight it and threaten legal action. They omitted to tell you the previous tenants extended which pushed your move in date. You didn’t agree to that move in date so whatever contract you have should be null and void.

If they refuse to refund it you can dispute it through your bank. We had the same thing happen. We disputed it through our bank and got the funds back the apartment complex didn’t fight over it cause they would have had to admit they were in the wrong.

I submitted to them as a recognized charge and explained the situation. They agreed it was messed up and refunded it as well as reached out to the property manager for an explanation

Yeah that’s bullshit. I would definitely look into it further if I were you. They likely told you outside of the 3 day window for this very reason.
