OVI/CHILD ENDANGERMENT HELP!

This is my niece, Delilah. Her and her mother live with me currently and the other night I got a phone call around 1am (when my sister gets off work) my sister said she had been pulled over and received and OVI. Of course I freaked out. Anyways, I drove literally less than a mile to where her car was pulled over. The officer left her in the car alone. No supervision. She was SCREAMING when I opened the door to make sure she was okay. The officer tried to unbuckle her but didn't know how so he messed up the base and I had to completely re do it. 
    Anyways, I have to follow him to the station and wait for jacque (my sister) to be released to me. Delilah is still screaming and the officer bitches at me and says "you should probably feed her" meanwhile he won't let us into the station so I can get water for a bottle for her. So I wait in the car with a screaming child for an hour. 
   She was finally released and here's the story: she was NEVER even drinking. She turned into the furthest lane and the cop pulled her over. She asked why she was being pulled over and apparently the cop got smart with her. She tried to blow, but it didn't register. And then she has scoliosis so one hip sits drastically higher than the other so she couldn't pass a part of the sobriety test. Anyways. I'm just asking opinions. Was this fair? To give a 22 year old mother an OVI  and a child endangerment offense when he had no proof?!?!
