Just wanting to vent

My ex bf has served me with court papers saying he wants sole custody of my 4 yr old. Mine you he hasn't been that great of a father for her only when he deems appropriate. Now with a new baby and gf. I honestly don't mind and wish Her the best. Hopefully he can be a father to her baby than he was to mine. Anywho how I. His right mind does he think this is even possible. My daughter is in great condition, healthy. Has her older sister to play with. My now fiancé and I have been very stable and even though we don't spoil her, our kids get what they need and get punish (no tv, games and have to sit down on the couch) if they don't follow a rule. Nothing big. My question is, was it wrong for my fiancé to try and talk to him, father to father, about bringing her home on time during my exs days. I mean our kids have a bedtime and if he was gonna be late at least answer a call or text. He stopped coming to pick her up in March and I got served this Tuesday. Now he's messaging me constantly trying to see if she( my daughter is ok)
