Hiring specifically from certain racial groups?

Is this fairness or detrimental to other groups?

There is a sushi restaurant by my house. They had a big sign out front saying they were hiring. At the bottom it said

YOU DONT NEED TO BE ASIAN.......seriously!!!!
It was hilarious! And now there are a bunch of white people working there.

Hiring for a specific racial group is not legal in the U.S. Is it legal where you are?

In the army there was what we call equal opportunity employment. There had to be certain amount of variety in the place. So yes I believe to make it equal in a big corp is okay.

I thought there was an equal oppotunties policy in every workplace.

The company I work for actually has to hire a certain number of special needs/mentally ill workers.

Since the majority of stores are white owned and have mostly white workers I do specifically enjoy and seek out buying/supporting businesses and products owned by people of color.

Technically if we used the merit based  system it would be very fair in my opinion.

Just to let you all know, i posted this as it has come up as a clause in a legally binding contract I am looking at. I wanted thoughts on this as it's the first time I have ever seen this separately mentioned to equal opportunity and discrimination clauses.
