Fathers rights?

not about pregnancy but... 
me and my boyfriend recently split up and I'm wondering what rights he has with the baby. She is 4 weeks old, and he works Monday-Friday and Sunday, 4am - 2:30pm. Does he have rights to have her over night, and how many days is he entitled to have her?

It depends on where you live and sometimes whether your breastfeeding or not. I had a friend go through a divorce in Michigan and the father was not allowed more than 2 hour visits at a time and 4 hour visits after 6 months until her son was weaned from the breast. She ebf no bottle at all until 15 months I believe. Every state is diff and so is every situation. Best thing is to try to work out a civil arrangement on paper with just him and have it notarized. Unless you have a fear he won't take care of the baby properly or help you with support outside of court. If that's the case it's best for you to file papers first. Good luck 😊

In Texas if he is or isn't on the birth certificate doesn't give him rights. Have to sign Aknowledgement of Paternity, since you both aren't married. Then a negotiation appointment will be set up, then it should get settled (if not goes to court) idk how your & his relationship (regarding coparent) or if he is just telling you he wants the baby overnight, he doesn't have that right. In texas for overnight is if child is 3yrs or older. Under 3yrs old: visitation starts off short 1 day (1-2 hrs) every other week.. Then starts increaseing. They go by this since child is primarily with primary custodial parent, which is you. Babies are too young to be away from mom for a period of time.

Normally a judge won't give dad's overnight till baby is a bit older but that likely depends on the state your in. Where I'm at they don't get overnights till baby is 2 cause they have a strong need for the mother

It is one of those things that is better for you two to agree on and have it notarized or you're going to need a lawyer and you're going to end up in family court. Every state has different laws when it comes to custody.

Talk to him and work around his work schedule. Right now the baby obviously isn't on a set schedule so he has to be understanding of that. If you are not breastfeeding then he could take the baby once or twice a week for 5 or 6 hours. Maybe if you two are civil have him come over once or twice with you and show him how to take care of the baby and that will probably help your relationship as parents to this child and put it on a good foot to start with if at all possible. Plus it will help you to feel more comfortable that he is capable.
