The driver because they ask for his license and information.. The ticket is written out to whoever is driving.

I'd say the person who earned the ticket. Though if you're like us and pool all the income together it doesn't really matter.

The driver. They usually ticket an owner only when they cannot identify the driver and even then the owner can just prove who was driving to get out of the ticket. Most speeding tickets are issued in person so the officer will ticket the driver. If you live in a state with speed cameras where they ticket you in the mail without pulling you over in person then I guess the ticket will be in both your names but if you prove he was driving it is his responsibility...
