Is this evidence for custody?

I clearly don't have enough right now, but baby daddy parties nonstop and I don't want him having anything to do with his daughter. It seems selfish but I won't let her around his drunk driving ass who's house smells like weed constantly. I did as much lurking as I could since he blocked me on Instagram where all the good stuff is, and I have a tweet that says 'god I was so drunk last night 😂' and he's only just turned 19. He posts a lot of pictures of his friends passed out drunk or throwing up but none of him, so I don't think I could take that to the court even though they're all underage. Is the tweet something I should take in or do you think it wouldn't be looked at as serious evidence?

If you aren't married he doesn't have any rights to your child. If you are not married you don't even have to list him as the father on the birth certificate. If he really drinks and does drugs, I'm sure there's been altercations between the two of you. File a restraining order. Best of luck to you. I'm sorry for your little one having to go through this!

I had to get a peace bond from my babies father after we split up. I am in Canada but they gave me the choice to have it put on his record, and I denied it because I didn't want to cause anymore problems. I recommend you do not do the same as me, I wish I had had him charged because now my husband and I are looking to get full custody, and do the have it as leverage for our case. People really don't change

Depends on where you live. It definitely wouldn't be enough in Canada. You would have to prove without doubt that he is an unfit parent, otherwise courts will not give sole custody to one parent or the other. They see it as a child's right to their parent, not a parents right to their child. Look into a parenting after separation class, it teaches you a lot of different ways to cope and deal with situations like this both legally and emotionally. Good luck!

It unfortunately doesn't matter on the US court system. My ex got in a car accident with my kids after he had a dui and should not have been driving. He also had sex with his gf on the bed where my kids were sleeping. He even showed up drunk to the park. And the judge still have him weekends and Wednesday's. I had to talk him into agreeing to just 3 weekends a month and paying less in child support 😕💩

That doesn't prove anything about is parenting. The goal of the courts will always be to have both parents in a child's life, so you would need something to really prove he's an unfit parent.
