You can name the baby with his last name BUT he has to be present to sign the birth certificate.  If you guys aren't married he has to sign a waiver of paternity acknowledging he is the father.

You can take your papers to the place where he is incarnated. They have notary publics there for legal paperwork. They will take your papers and pull him have him sign and notarize it and give it back to you. Lot of legal paperwork is done at jails and prisons for all sorts of reasons and this is one of them. Contact his case worker if he has one or the jail office and they will help you with all you need to know. Hope this helps.

My cousin was in jail and we needed to have him sign titles for cars and put his property in storage . We had to have a notarized letter to handle his affairs as well as a letter of incarceration.
