You'll have maternity leave no matter what, whether you'll still be paid is a different story. Some require a certain time to get paid leave, some dont. I work for a contractor under the ACA and our STD started on our first day. I'd ask them about time frames.

I was under the impression FMLA was only for employees who have been there at least 1 year? Or had a certain amount of hours in before needing leave.

It also depends on the company.  I'm sure Wells Fargo counts but for small companies under 50 employees they don't have to comply with FMLA to guarantee your job will be there when you come back. It sucks.  So you may not be covered.

I'm worried too cause I work for a small company. I doubt they would not hold my job though cause I'm the ONLY person who does my job. But I was considering looking for a new job soon but we're TTC now and I'm holding off looking cause any new job I take I wouldn't be covered by FMLA if we conceive soon.

In order to be eligible for FMLA leave, an employee must have been at the business at least 12 months, and worked at least 1,250 hours over the past 12 months, and work at a location where the company employs 50 or more employees within 75 miles.
