Cohabitation vs marriage

Ichigo • I have one daughter. I'm also pregnant with my second. Unmarried.
So, baby daddy and I are considering making a cohabitation agreement as opposed to getting married. Long story short, he's not sure what he wants right and I've defined marriage as nothing but a contract anyways so we decided this may be the best way to go. Plus we can put it in the agreement after x amount of years we should get married, problem solved. Only, no problem not solved since my state does not recognize common law marriage anymore, and as a fostet child, I've no family, so if I get injured theres not a damn person to call the shots abd if one of us dies without striking up a will, the other is out of a home. So what should we do
