Visitation rights question..
My husband has not seen his daughter since Christmas <a href="https://play.google.com/store/apps/details?id=com.glow.android.eve">Eve</a> when her mother's boyfriend came with her to pick up the little girl (they have both been told multiple times we do not want him on our property) and ended up assaulting my husband (ended up being a felony because he not only stabbed him, he hit him with her car)
They have not arrested the boyfriend, mainly because they cannot locate him to serve the papers.
DHS was brought into it after the 3rd week of no contact and was made aware of the incident since the child and her mother live with the boyfriend. She has physical custody but he is supposed to have her Friday- Sunday every week.
DHS told us that they were looking into it but as of yet had not been able to locate the mother (her address with them is her mom's house) and they would keep us updated.
That was mid January. We have tried to check into it, no phone calls returned no matter whether we call the field office that's handling it or the state office. We have been told "through the grapevine" that the mother told DHS that my husband had hit her with a baseball bat and that's how she has a scar over one eye and two teeth missing.. when really it was the boyfriend and that we lied about what happened Christmas <a href="https://play.google.com/store/apps/details?id=com.glow.android.eve">Eve</a> even though we have pictures and the police reports to prove it. We were told she said the DHS caseworker told her just to not let him see the daughter anymore if she felt it was unsafe.
My question is can they do that and just close the case based on mother's statement without investigating? And would they not have to go back to court to terminate his visitation rights?
Just at a loss for how any of this is right/legal and where to go from here short of a lawyer
