Fourteen year old's boyfriend spends the night. They are sexually active. Is it neglect/endangerment?

I don't know if this is technically controversial or not, but I wanted to see what the general consensus is about this.
My husband's ex allows their 14-year-old daughter's boyfriend to spend the night, regularly. The two are sexually active (I've asked my step-daughter directly), her mom is aware and still allows him to spend the night. My step-daughter is not on birth control but claims to be "safe" until her mother takes her to get birth control (who knows when that will be). 
Either from a legal or moral standpoint, would this be considered neglect through neglecting to parent, or endangerment through enabling sexual activity between two minors? Or is this just a "it is what it is" situation?
Would you allow/enable this?
