if i don't but my abusive baby father on the birth certificate, does that mean he will have no rights or custody?

to hear from you guys about this! my baby father has been abusive to me for 6 months out of our year relationship and now he is in jail. but my question to you guys is if i don't put him on the birth certificate, will he have any type of rights to my son? or custody? i'm not worried about child support at this point honestly..i'm going to call a lawyer tomorrow and find out for sure, but i did look online and it said that if i don't put him on, he will have no rights, no custody, no visitation, and no child support. i am NOT the spiteful bitch kind of person because i have respect that he's the father of my son...but the fact that he's been telling everyone that he wants nothing to do with me or my son really got to me and broke my heart. (not that he hasn't 7 times already) and i'm just done with his games he plays with me, along with everyone else. so if he doesn't want to be involved with his son Aiden, then that's what he'll get. but does anyone know for sure if i don't put him on the BC that he won't have rights or custody? please let me know if anyone knows for sure about that

update: i've talked to a lawyer, and she said that if i don't put him on the birth certificate he won't have any rights, custody, visitation, of child support. and it's up to him to fight for custody through the courts if he even wants to. so i do feel much better now that i don't have to go through court myself

Taking away parental rights is a legal process. Simply omitting his name on the birth certificate while not take his rights away.

He can get a judge to order a paternity test. Keep all aggressive texts he has sent you.

You can leave him off and he won't have rights. 
However he can later petition the courts for custody and have to have a paternity test done and they'll put him on it anyways. But if you leave him off, and he doesn't petition, then  it won't be a big deal. Just a matter of what he does between birth and 18 years old.

You are not obligated to give or put his name on the birth certificate if he's in jail. I'm pretty sure he won't try to take your baby from you bc that will require him to be a good person who cares and it's willing to spend money on lawyers and actually waste time going back and forth to court. I would not put his name, if he actually tries to take you to court save everything you have against him, including that he's been in jail for domestic violence... this is a process that would take years and even tho I don't believe he would gain any custody it's better to be safe than sorry ! Get yourself a lawyer bc while he's in jail he has no custody !
