Would you have sex with someone you know is drunk and you’re sober ?

I was just wondering wouldn’t that count as assault ? If you knowingly have sex with someone say a friend one you know would not do it if they were sober but they initiated . This did not happen to me I was reading a fan fiction and the author wrote a chapter we’re the guy is drunk and his friend helped him inside his home and he started kissing her and she had sex with him he is a grieving widow and it was his anniversary . He woke up the next day mad and yelled at her . I was really disturbed and wrote that in my review well the author did not like my review . So do you guys think I’m wrong ? Because if someone is inebriated they can’t consent to sex right ?
