Should this elderly man receive the maximum punishment (read)

A mother took her 5 day old baby out to go grocery shopping when a couple came up to her while she was talking to a neighbor she recognized

It was a young lady and a 65 year old man

The lady told the man to come look at the precious baby girl and once the man saw her he immediately closed his fist and punched her leaving a dent of a fish on her forehead

The women’s other daughter say what happened to her baby sister and thought the man had killed her

The man immediately apologize for hitting the child because he thought the baby was a DOLL

The mother called 911 &

He was later charged with assault but made bail and was released

The baby was admitted to the local hospital which she is doing okay reports say

But do you think they should of denied bail for him and kept the man there for assault a newborn baby?
