2 nights ago, I got concussed at the gym due to hitting my head on another persons weights as the machines are way too close together, I split my forehead open and was gushing blood all over the place that the cleaner actually wanted to call the police because he thought if was a crime scene.
There were staff on at the time but no one thought to check on me or seemed to be aware of what was going on, despite the heavy bleeding.
Yesterday they kept calling me to see how I was doing, apparently they only found out after people posted photos of the bloody floor on Facebook and went back to watch the security camera footage. They’ve admitted to knowing that the machines are too close together and that it’s always been a problem. I’ve had a headache since the injury however, other than that, I’m fine. I did spend a few hours in the emergency department for a few hours that night, they stitched me up and I’ve had to go back daily to have the dressing changed, I have had to take the last 3 days off work due to my headaches and theres not much I can do other than sit at home till they wear off.
My question is, can you sue even if your injuries aren’t that bad? It shouldn’t have happened at all and could’ve been prevented had they done something to address this known issue, sooner.
EDIT: the guy whose weight I hit my head on and another guy that was training near me, put me in their car and took me to the emergency department and the gym staff had no idea what was going on.
