Inmates cannot consent to sex - possible TW
In my local news recently, a story came out about a jail employee who had sex with 3 inmates. She was charged with rape, because inmates are incapable of consent (according to our state law).
Do you believe that once a person becomes an inmate they should lose their ability to give consent to sex?
I think that they should remain capable of giving consent to sex.
Exceptions:
1) Unless they were unable to before becoming an inmate, then they would continue to be unable to give consent (can’t think of an example of when this would apply, but I’m sure there’s one out there).
2) if an jail employee abused their power to take advantage of the inmate, because this would be considered rape regardless of the victim being an inmate or not.
From reading the article, the inmates were willing to have sex and I feel as though facing 3 counts of rape charges is very harsh punishment for this woman. Do you agree or disagree?
EDIT: the employee was not an officer, she was a cook. That does not change my stance. Does the job title change your opinion?
