Would you sue and push for a citation?
Let me preface this by saying, I have an appointment with a lawyer this week to talk it through, so I am in no way asking for legal advice, I’m just curious.
Two weeks ago I was driving home from work, on my way to pick my son up from daycare. It was a nice day, dry, blue sky, 4:30pm so still daylight. A driver coming from the opposite direction did a last minute illegal u turn and t boned my drivers side sending me flying over a curb totaling my car. The driver of the other vehicle was 16, admitted to me and the cops he didn’t look before he turned and was able to drive his car without issue after the accident. Thankfully my 2 year old was not in the car, but I will add, even though the car seat was installed properly and checked by a police officer to confirm, it definitely was moved from the impact.
The cops came, I picked up the report today. The report is clear and names him 100% at fault but they didn’t issue him a citation for the illegal turn which caused the accident.
I did go to the hospital after the accident. I have a giant bruise on my leg and a strained shoulder. I have to go to PT for the shoulder until the pain is gone.
So the question is, would you sue this kid? Would you call the police station and demand he be cited?
