FMLA laws?

Stay at home mom here.. SO and I are expecting our first child together July 1st. His place of work has FMLA (family medical leave act) and he had applied for the caring and bonding time with our newborn. They have since informed him he is not eligible because we are not married and considered “domestic partnership”. Anyone been through this situation or know anything about it? I’ve googled and found both mothers and fathers legally qualify for FMLA to bond with newborn child as long as they are the biological parent.
