My worst nightmare almost came true yesterday. I’ve been having and on and off custody battle with one of my child’s fathers for the past 6 months. He is currently on child support and is granted supervised visits. Except the place that held the visits have discontinued those services there and I am not putting my safety at risk to meet with him alone. So he is now asking for full custody through a modification since it’s been a year now. His reasons for supervised custody was for choking me while pregnant. We have had 3 court dates for the modification. The first one he did not show up to, second one we both showed but the judge rescheduled, the third one had a bomb threat at the courthouse that day so it was rescheduled (I was not notified) on the 8th neither one of us showed that day and it was rescheduled without notice AGAIN FOR AUGUST 7th. Yesterday I got a call from my child’s father asking to drop off some things and I told him to drop it to my mothers. He then said he coming to get my son because he has custody. He showed up with cops with paperwork. I was never sent a letter or a email never got a call, no constable came to my door or nothing!!! I told told the cops they couldn’t have my baby that he was dangerous and he had pending charges against him and that he had already lost his other children to cps on the 13th of July. He had been threatening me I have proof but they weren’t trying to hear that. I demanded to speak to the sergeant! They weren’t just giving my child to this now criminal that I didn’t even know anymore!! I was in tears I was shaking (I have ptsd) I’ve never felt a fear like that before and I’ve been through more than the average person. The cops were threatening to taze me if I didn’t give my child up before I took my phone out and started recording and asking for a sergeant. The sergeant came and spoke with the judge. We had to go to court immediately after that. We went and the judge is still trying to give him the custody for a week until the court date is reset. I almost loose my mind but somehow hold it together to tell him that this man is dangerous and is it their duty to make sure that my child is going to not just his father but a safe environment, I stress to them that they won’t be able to heal broken legs like the one his baby brother had (his fathers other child). I then ask the judge to show me where it says that I was notified. (I know they keep record of letters sent) He then said “I’m going to let the child remain in your custody until August 19 which will be your rescheduled court hearing date.” I ask him again to show me and he says....”I’m trying to work with you please,” By this time I’m upset and I tell the judge that that’s illegal. That he gave him custody illegally ! I can not show up to court if I’m never notified!!!” (I’m calm as a whistle so doing good) he then says that the attorney general said they notified me 😒 I left with my child and shook for hours and held my babies as long as they let me...cried for a good minute when they wanted to play...kept looking at them and telling them I loved them and how special they all are to me and they slept with me and my husband last night 😢 what would you do in this situation? I don’t have much money surely not money to pay for a lawyer but he makes too much to get legal aid 😢
