Changing my last name

So when my husband and I first got married I kept my maiden last name because our marriage was supposed to be a secret at the time. Our marriage certificate has my maiden last name on it. Now it’s 4 years later we have a son and of course he has his fathers last name so now I feel left out😂. Also it has been such a pain to have a different last name then my son because my son is a mixed I’m Mexican and my husband is white but my baby looks completely white so I’m constantly having to prove I’m his mother. It’s gotten to the point that when we need to do anything medically or with daycare I have to either bring his birth certificate so they can see my name is on it or my husband has to come along with us.

I want to finally change my last name so it not such a pain but also to complete our little family. I know it’s going to be a long process because I have to file a petition to the court and all that Jazz. Has anyone gone through this process before?

Also we got married in California and now live in Texas I’m confused if I would have to file in California or not. I tried to look things up on the internet but I couldn’t find anything on that.

The marriage certificate usually has your maiden name on it. You can take your certificate and fill out a piece of paper and bring it to your social security office to change your last name there first then license etc.

You do not need to file in the state you were married. I was married in Vegas and did my stuff in Cali

It’s actually not as difficult as it seems. As long as you are married, You simply take your marriage license, SS card, and driver’s license to the SS office. They handle it from there. Once you get your new SS card, you go to the DMV and get a new license. It’s all pretty simple and took about three weeks total. Good luck and congratulations!!!

You dont have to petition court. Your marriage certificate allows for a name change just take it to your bank and send a copy to the SSA and any other place where you want to change it.

I don’t know about the legalities of changing your name but unfortunately it may not help as much as you think. My son is mixed and I am white we have the same name and still run into problems..you’d think people understand biracial families and adoptions but nope! Because I’m white I don’t have as many problems as my husband does..I think people are afraid to say something to me or question me. Mainly just off hand comments by strangers not people in authority. I’ve had daycare workers try to hand me the wrong kid (random white kids) and people call my Puerto Rican step-mom his mom..

There should be no difference just because you’re changing it late. Marriage certificates always have the maiden name. Just go to the social security office and dmv/dps and change your social and license. And then do the rest.

You should go to your county clerk office. They can answer all your questions.
