Question

Mg brother and his best friend got into a car accident, they both were hurt but they’re okay now. My brother has medical insurance that cover his medical bills and was the passenger of the car accident. His best friend was the driver and they swerved due to a deer running out in front of them and that’s how the accident happened. A few people in my family are urging my brother to sue his best friend for pain and suffering where as a few people are urging him not to sue because it was an honest mistake, it was his best friend, and has to debt in medical bills due to this. What’s y’all opinions?

Sounds like a few people in your family are trash bags.
Why would you sue a friend for an accident that wasn’t even their fault, particularly when you have insurance? That’s one of the most awful things I’ve heard in a long while.

Honestly, kind of ridiculous that people are urging him to sue his BEST FRIEND. There are deer everywhere where I live and you are bound to hit one or have to break for one. They just stand on the side of the road eating...not much you can do to control wild animals running out in front of your car. If someone I was driving with hit a deer (again this is high likelyhood for me) I wouldn't sue them!
I will play both sides though and say you really should be hitting the deer if it isn't safe to break. You're supposed to slow down but right at impact release the break so that the deer launches away from you and doesn't end up on your windshield, causing an accident. So yeah, swerving wasn't the best decision but most people would make it. I stupidly swerved for a deer going a few weeks back and I know better. Shit happens. I think everyone should just be happy they made it alive and grateful that insurance is covering medical expenses.

He won’t win a pain and suffering claim.  He would have to prove that his friend did it on purpose or your brother’s “damages” were caused because his friend was negligent.  He will lose that case.  So filing the suit will cost your brother and he will lose his best friend.  Your money hungry, sue happy family members should educate themselves before suggesting to a young person, such as your brother, to do such stupid things.  You gave your brother good advice.  I think you should reiterate it to him again.

His friend was not negligent. His friend didn’t cause the accident by doing something wrong. How on earth would he have known a deer was going to run into their path? That would be a scummy thing to do, in my opinion.

No and I’d be weary to let any of those sue happy relatives ever step foot in my home again. They have shown you they have no morals, so who’s to say they wouldn’t sue you if they fell down your stairs?
