Anyone in HR in the US?

Just curious if my employer is allowed to call me to ask if I’m coming back from my maternity leave.

They’ve called twice in the last few weeks and keep saying if I say no then it won’t affect my leave at all but they’re trying to “reorganize” - I found out from a colleague that they are doing layoffs and combining my program with another and they can’t have both supervisors.

Just looking for some advice. I’ve said yes I’m returning both times bc I don’t want to say I’m not and risk not being able to get unemployment if they decide to let me go bc I said I wasn’t returning.

Also- I’m on FMLA and no longer receiving short term disability benefits and my job isn’t paying me so idk how saying no would affect anything bc they aren’t paying me.
