How does child support work? Ex doesn’t want to help

Question

I’m currently unemployed with a 1.5 month old baby. I quit my job during my pregnancy and have been living off my savings. Can I still file for child support? I’m scared the judge will ask me why I am not working. I don’t plan on getting a job again until my baby is 6 months old but I’m scared it will backfire on me in court. Will my employment status affect me if I file for cs? 
The father refuses to help me out financially. I have tried to be civil and express that it bothers me he does not help but he still doesn’t do it. The only gift he has given my baby is ONE ONESIE that didn’t even fit her. He just expects me to let him see my child when he randomly appears at the door. He refuses to arrange a set visitation schedule with me and doesn’t show up when he says he will. 
I would like to clear out that he isn’t on the birth certificate.

You don’t have the luxury of staying home at this point and need to get a job. File for child support but it doesn’t guarantee he will pay. You likely qualify for state assistance as well. 
Maybe the two of you should set a custody agreement in court.

File for child support. Your employment status has little to do with it. Child support is to even out the household financially for the child's benefit. If the judge asks you why you're not working, say because you have a child and cannot afford childcare. They will establish paternity, and depending on his financial situation, he will be ordered to pay child support. It may not be much, but depending on his work situation, it could be more than the minimum. You don't know unless you try. Be warned that he may try to get some sort of visitation. If he does not want to pay anything, he will need to give up his rights.

Even if hes ordered child support it doesnt mean he'll indeed pay you!  The only way to ensure definite financial stability would be to get a job! There are human resources to get help for your baby

Just a point of notice- the minimum set by DSS in New York for child support is $25 per month with $7 being “acceptable” if he can claim and prove hardship. I wouldn’t bank on it too much, even if he were to pay it or have it garnished. As shitty as it is, I’d look into whatever assistance possible and get back to work ASAP. I’ve been fighting on this front for the better part of the last decade and it doesn’t get easier 🙃

I believe they will most likely establish the paternity by doing a test then they would ask if you all would like to arrange an agreement where y’all would set a schedule that’s not court order. This is where you need to refuse & proceed with court ordered as well as visitation, lastly they will ask about assets & it does not matter if you’re not working. You’re not working because you have to attend to your child that’s all. I used to live in NY & had to go through this in their system but we did arrangements which a was a dumb move because he never stuck to it. I moved to NC about 2 years ago & im fully committed to getting the help I deserve!

You can file for child support but why on earth would you quit your job? Especially with a baby to support? You need to find another job ASAP!!
