That test is positive and HCG is positive. You either ovulated later than you think so you’re earlier, or HCG isn’t rising properly. At 12 days late (assuming your test was positive at missed period) your HCG should be much higher. Now if you just got a positive test a few days ago then an HCG of 44 makes sense. And if that’s the case then you likely ovulated later than you think!
