Rent stolen from management dropbox

So my landlord called to tell me the rent was stolen from their dropbox i canceled the check immediately after being informed. Now they're asking for me to pay again which is kinda an issue right now.. i have proof i put in the dropbox, receipts from my bank etc... my question is am i still responsible to pay again? I live in oregon. Edit. Ive read similar posts on google with responses from lawyers saying its not the tenants responsibility if theres proof of it being dropped off in the dropbox of management & if its not cashed .. i cancelled it because they told me to but i also have proof they stole it because i never said what type of check it was & the landlord was asking me to CONFIRM what was on it. @lauren its not common sense to someone whos never been in this situation!! Obviously thats why i asked. For everyone saying the money didnt come out of my account IT DID and wont be returned until after 90 days!! So therefore its gone. Its A Cashiers check .The bank is doing an investigation.

You cancelled the check. So not money came out of your account so yes it's your responsibility to pay your rent. This is common sense.

I also live in Oregon and would have the same questions if it happened to me you can teach somebody without being rude nobody wants to learn from a bully and the person said it was a cashier's check not a personal check so those are way different if you didn't know that

Well yea you still have to pay your rent. You canceled the check, so you still owe them money.

It’s a check. Money doesn’t come out of your account until the person receiving deposits it. So since you canceled that check, the money will not come out of your account. Writing a new check will not mean double paying rent. If possible, I’d highly recommend using a more secure way to pay your rent.

I know what a cashiers check is. OP edited their post to add that it’s a cashiers check, which is totally different.

It's a cashiers check, so the money has already been transferred to the banks account at the time of ordering the cashiers check. It's not like a regular check where the recipient received the money from her account. The recipient draws the money from the bank, not from her.

Unfortunately yes you can be. I've had this happen once too (with cash 🤦‍♀️) but luckily the rental company had cameras and saw that we did indeed drop it, and who stole it. So they didn't require us to pay it again. But I've heard of others having to repay it because sadly, that sort of thing has been happening alot in my town. You still need to pay rent regardless, hopefully the check doesn't go through anywhere and hits back into your account, I'd talk to the company and see if they'd atleast work with you.

To your edit- I'd contact a lawyer in your area. Tenant laws vary state to state, like where I live we absolutely have nothing in a tenants favor. And again, I'd just ask your landlord if they would work with you on paying them if that's the case. Show them the proof that the bank is investigating and you should have the funds back in 90 days.

They will do an investigation, and they will be able to tell who cashed it and where it was cashed, etc.… If it hasn't been cashed, they can put a stop payment on it, but like you said, it can take up to 90 days to get the money back into your account.  Generally, if they were able to put a stop payment on it, then it has not been cashed by anyone, and that would mean once you get your money back, yes, you still need to pay your rent.

For those confused about how a cashiers check works... the money is taken out of her account at the time when she orders the cashiers check, which is basically like a money order through the bank. Then the bank holds the money and the recipient cashes the check through the banks own accounts, it does not come straight from her account.

The money did come out of your account? Were you still able to cancel? Can the bank show proof of this-go in and ask to speak to someone if you haven’t already

I don’t think you can cancel a check that’s already been cashed. You can dispute it but if it’s already cashed, canceling wouldn’t do anything. If you’re sure the money came out already, and have to wait 90 days for it to be put back, I would see what your rights are as a tenant.

Of course. Your bank should be able to work with you though and retrieve that stolen money though. I’d contact your bank asap to figure out what you can do.
